AGB`s Shop (consumer)

We are pleased that you are ordering a product from our mood-for-food.ch shop. Please read our general terms and conditions carefully. They apply to all of your orders.

1. Scope and conclusion of contract
These terms and conditions apply to sales contracts between you and MOOD-for-FOOD.ch, operated by MOOD-for-FOOD by Tom Bruppacher, Bergacher 7, 3045 Meikirch, tel: +41 31 558 20 21, email: mood-for-food @ gmx.ch.

The order is confirmed by us. It is binding as soon as you have clicked on the order button at the end of the ordering process.

2. Range and prices
We are constantly adapting our range in terms of selection and conditions. The current prices that can be seen online at the time of the order apply. Price changes and errors are reserved. The prices include packaging and shipping costs.

3. Order
All orders are fundamentally binding. By completing the order, you confirm that you have checked your entries and that the order data transmitted is correct. After the order has been completed, orders can no longer be changed, or only with restrictions or after written confirmation. Please note that orders can neither be deleted nor merged after they have been sent. The processing of your order usually begins on the same or the following day. We reserve the right to reject orders without giving reasons.

4. Delivery
In order to guarantee the freshness of the products, deliveries are made directly by the producer. The current delivery times and shipping options at the time of the order can be viewed online. Seasonal or climatic restrictions can lead to delivery problems for individual products. In this case we are entitled to make partial deliveries at any time. If we inform you about delivery obstacles, you can cancel the order of these articles free of charge.

5. Warranty and liability
We guarantee you a high-quality delivery that complies with your order. We also endeavor to keep our very short delivery times at all times. If we cannot meet the agreed quality of our products for once, the items can be returned unopened within 10 days. The item price will then be refunded to you.

We expressly reject any liability for damage resulting from improper use of our products or from the use of the products. You have to ensure the proper and professional use and processing of the products. Instructions and special product information that we provide online for the products must be carefully observed. In particular, products must not be consumed beyond the expiry date. Further claims are excluded.

6. Right of return
Transport damage:

In the case of obvious transport damage, please contact the transporter immediately and request a claim form, as the transporter, as our logistics partner, takes over such damage and discusses it with you directly.

In the event of total or partial destruction of the product due to improper handling / processing, there is no right to a free replacement.

Production defects:

If the product delivered has obvious production defects, please contact us immediately at mood-for-food@gmx.ch or call us (+41 31 558 20 21) so that we can discuss the next steps with you. Please do not send any products back to us without prior agreement.

7. Products pictures

The product images in the shop are sample images. Our products are high quality and partly handcrafted quality products. The delivered goods may differ in appearance from the picture. This does not result in a right to a return or a refund of the purchase price.

Product quality:

We carry out regular quality controls of the products at our suppliers. However, it is not possible for us to control every single product. The suppliers enter into contracts with us in which they guarantee a high-quality product and corresponding delivery. The inspection, delivery and quality of the products, according to our specifications, is up to you. We ask you to report defective products and improper deliveries to us. We will then take care of the problem and fix the deficiencies.

8. Payment
We usually deliver our products against prepayment with PayPal or credit card, and in exceptional cases also by invoice. You will receive your invoice directly from MOOD-for-FOOD. Do not accept additional invoices directly from the supplier. If this notice is disregarded, MOOD-for-FOOD cannot issue a refund. Any reminders will be sent electronically by email to the billing address you have provided. The default interest is 7%. From the second reminder onwards, we reserve the right to charge a reminder fee of CHF 25. After the 3rd reminder, we hand over the claim to a debt collection company. A reminder fee of CHF 50 then applies for each additional payment reminder. All delivered goods remain the property of MOOD-for-FOOD until they have been paid for in full.

9. Copyright and Third Party Rights
With your order you confirm that you respect and adhere to all rights (trademarks, copyrights, etc.) to the products you have ordered. The copyrights and trademarks of the products sold and supplied are the property of the manufacturer. Should there be claims by third parties (producers, suppliers) against MOOD-for-FOOD in connection with the "MMOD-for-FOOD" shop, infringement of copyrights, trademarks or other rights, you are obliged to make these claims at your own expense and to compensate MOOD-for-FOOD and the corresponding producer for the damage incurred.

All products that we make available on MOOD-for-FOOD.ch are protected by copyright and may not be reproduced for commercial use without the written consent of the producers.

10. Data processing
We treat your data confidentially and only pass it on to third parties to the extent necessary for order processing. On our part, they are obliged to treat the data confidentially.

11. Application of law / place of jurisdiction
In the event of a dispute, only Swiss law is applicable. The place of jurisdiction is Bern.
